Victor Davis Hanson didn’t waste time getting to the point: after 90 days of Trump’s second term, where do things actually stand on immigration? The answer, he said, depends on how you measure progress. “There’s good news, and there’s bad news,” Hanson explained. “It’s like the trade issue, or Iran, or Ukraine—plenty of encouraging signs, but nothing final yet.” That tension between momentum and uncertainty, he argued, is showing up in the polls. Trump’s approval is hovering around 44 to 45 percent. Hanson believes that number is being dragged down by skewed polling on the left, but it also reflects something deeper—that much of the country is holding its breath. Waiting to see what sticks. Waiting to see if the change is real. And nowhere is that uncertainty more visible than at the southern border.

Hanson then broke down what’s actually going right. In his view, Trump’s early actions on immigration have already made a major impact. “The good news is that we've gone from 10,000 people entering illegally to zero, and we've got the highest morale ever.” He said morale among agents is through the roof. “ICE and the Border Patrol people are ecstatic at the work they've done.” Mexico, he added, is no longer cooperating with illegal immigration the way it did under Biden. “They’re scared to.” He also pointed to progress on the wall, which is now expected to extend all the way to the Gulf. “It’s a big success.” And what’s most striking, Hanson said, is how it happened. No sweeping legislation. No big reform package. Just basic enforcement. “Remember that kind of boogeyman? We need comprehensive immigration reform. We didn't,” he said. “We just needed to enforce the laws on the books. And we've done that.”

But for all the progress, Hanson said the story isn’t over. Trump may be in office, but the country is still living with the consequences of Biden’s border policy—and the legal system, in his view, is making things worse. “We don’t even know how many people came in under Biden,” he said. “It could be ten, eleven, twelve million. There’s no way to know how many actually stayed.” And yet, Hanson added, the government has a rough estimate. Somewhere between 10 and 12 million entries. But the real problem, he said, isn’t the numbers. It’s the legal double standard that’s emerged around them. “It’s surreal,” Hanson said. “It’s Orwellian.” He broke it down like this: “It was legal de facto for the prior administration to systematically and honestly break the law by destroying the border and allowing this 10 to 12 million people to come in illegally and to reside illegally.” “The courts did not entertain any objection to that.” “In other words, there was a blatant destruction of the law by the chief executive.” That chief executive, of course, was Joe Biden.

But what happens when a new president tries to undo that damage done? According to Hanson, the courts have flipped the rules. “The incoming administration who wants to rectify that abuse, in other words, it wants to enforce the law and say that you came in illegally and you shouldn't have because of the prior laxity of this government, now you've got to leave because you're still breaking the law.” But the courts are not applying the law evenly: “And they’re stopping these deportations for the most part.” Hanson concluded: “It is lawful to be unlawful—if you’re Joe Biden, according to the courts. But it is unlawful to be lawful—if you’re Donald Trump.” In other words, the rogue judiciary can pick and choose when the law applies or not.
